The following booking terms used have the following meanings:
PROMOTER: individual organising the event.
ARTIST: individual performer represented by LIAKO.
THE ARTIST AND THE PROMOTER AGREE:
Article 1: In General
These booking terms apply to all artist bookings placed by the CLIENT with LIAKO, at liako.eu/agency. By using this website you are agreeing to follow and abide by our terms and conditions and privacy policy. You agree that at any time LIAKO may change the services. In order to place an service demand, you must be over 18 years of age and you have to be an authorised user of the credit or debit card used to make your payment and have sufficient funds to cover the cost of the bookings. LIAKO retains the right to refuse any request made by you. When placing an artist booking you undertake that all details you provide to us are true and accurate and it is your responsibility to inform us of any changes to these details as soon as possible.
Article 2: Terms Of Booking
By placing an order you are offering to pay a service on and subject to the following booking terms. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from force majeure for which we will not be responsible.
Article 3: The ARTIST’s Services
The ARTIST is going to perform during the contractual event and will render a performance of average style and duration regarding his ARTIST´s personality. Nevertheless the ARTIST is not bound by any instructions or orders given by the PROMOTER or any third party concerning his ARTIST expression and the presentation of his performance.
Article 4: Fee of ARTIST
In return for the ARTIST services hereunder the PROMOTER shall pay a booking fee of 15% plus the ARTISTs’ gage. If the ARTIST services are subject to turnover tax (respectively VAT), the applicable turnover tax [Country] currently [00] %) shall be added to the net-fee and listed separately on invoices.
Article 5: PROMOTER’s Financial Obligations
The PROMOTER is liable to pay the ARTIST’s expenses for overnight accommodation. Hotel bookings will be done by the ARTIST’s agency. The ARTIST travels by plane and/or by car. The rent cost for flight tickets and/or the car and fuel has to be taken by the PROMOTER. It’s included in the gage. In addition the PROMOTER reimburses any travel expenses accrued in the city of the venue by the usage of a taxi against production of the respective receipts. The PROMOTER shall provide the ARTIST with a sufficient supply of catering and beverages before, during and after the performance.
Article 6: Payment
The purchase terms apply in Euro (€) currency per project and exclude VAT. Tax is applied under Belgium Law (21%).

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.
b) Banking transfer payment
The agreed deadline is 10 days prior to purchase date. Any work, including any consultation, or delivery of information after the first contact will be the object of remuneration. Any changes made during the contract by the customer to the nature or complexity of the work and any change in use may result in a revision of the initial remuneration. 50% of the total amount due must be paid 4 weeks before the date of the event. The remaining 50% of the total amount due must be paid on location after the event.

The process of payment transfer can take up to three days. Once the payment received an email will be sent to the CLIENT with the purchase confirmation whether it is a downloadable product or a physical shipping good.
The ARTIST is a resident in [Country] and thus a resident [Citizenship] taxpayer. The ARTIST will meet his tax liabilities (e.g. regarding income-tax) personally.
Article 7: Impossibility of ARTIST's Performance
In the event of impossibility of the ARTIST’s performance due to illness all obligations and claims (incl. costs and expenses for hotel, travel, etc.) resulting from this agreement or any other legal reason expire. An alternate date requires a further explicit agreement in writing between the parties hereto. The ARTIST has to inform the PROMOTER about the illness without culpable delay and has to forward a medical certificate.
The same applies in case of extraordinary and provable personal reasons of the ARTIST (e.g. a perilous illness or a case of death of a family member).
Advance payments that have been received will be reimbursed.
In case the ARTIST fails to appear and there is no reason justifying this according to section 1 or 2, the PROMOTER may claim compensation for payments already made (see Article 4, 5 and 6. The ARTIST’s liability for any other claim for damages arising in relation to his non-appearance shall not in any event be in excess of the net-amount of the agreed Fee of ARTIST to be paid hereunder.
Article 8: Cancellation of the Event / Right of Withdrawal
In case the PROMOTER cancels the event or in case of the cancellation of the event by the PROMOTER for any reason lying in the PROMOTER’s sphere of responsibility and / or sphere of risk, P’s obligation to pay the agreed Fee of ARTIST.
Cancellation costs are, independent of the distance to the event date, 50% of the ARTIST’s fee.
Withdrawal 2 weeks before the event: 100% of the fee.
Article 9: Attribution of jurisdiction
This Agreement is entered into and shall be governed by and construed in accordance with the laws of Brussels located in Belgium.
In the event of a dispute concerning the execution and interpretation of this agreement, the parties shall first seek an amicable agreement between themselves, in particular through the use of an approved civil and commercial mediator. Failing that, the courts of Brussels will settle the dispute and the Belgian law will be the only one applicable.
